A registered patient in Massachusetts can buy no more than a 60-day supply in each 60-day period. 935 CMR 501.002 defines a 60-day supply as ten ounces unless the certifying provider sets another amount. The Commission explains how the allotment resets and who can change it. This page gives the rule in order, with the examples the regulation uses.

The rule

935 CMR 501.002 defines the 60-day Supply as the amount of marijuana, or equivalent amount in marijuana-infused products, that a Registered Qualifying Patient would reasonably be expected to need over 60 calendar days for personal medical use, "which is ten ounces," subject to 935 CMR 501.010 and unless otherwise determined by a certifying provider. A treatment center may not sell more than that amount to a patient or caregiver (935 CMR 501.140(4)(c)).

The Commission patient page says the maximum amount a patient may possess at one time is a 60-day supply, or up to 10 ounces. A certifying provider may certify a larger quantity.

How the 60 day period works

935 CMR 501.140(3)(a) gives two examples for a patient with a ten ounce supply:

The amount counts marijuana contained in marijuana-infused products, not just flower. The regulation example covers patients certified for 60 days or longer. It does not say how the limit works for a shorter certification, so ask the provider.

When your allotment resets

The Commission FAQ explains the reset in plain words: "Your medical marijuana allotment resets 60 days after the previous purchase date, so the date may not be exact depending on how many days are in the month." It adds that your allotment only returns to your fully certified amount when you do not make purchases for 60 days. If you keep buying as the allotment refills, it will not reach the full ten ounces, but you can still buy up to the quantity available.

To find when your allotment is replenished, the Commission says to log in to the patient portal and review your purchase history. Find your most recent purchase, then the date 60 days before it. The amount bought on, or closest to, that earlier date is the amount that comes back.

Changing the amount

Only your provider can change it. The Commission FAQ answers "How do I increase my purchase limit?" with: "Contact your Certifying Healthcare Provider. The Commission is not authorized to increase your purchase limit." Under 935 CMR 501.010(10), the provider documents the amount and the reason in the medical record and in the Written Certification.

Initial Access

A new patient on Initial Access can buy a 14-day supply, defined as 2.5 ounces, for up to 14 days unless the provider certifies a different amount.

This page does not describe what any amount of marijuana does. AC does not recommend any certifying provider.
