If you hold a medical card from another state and you are visiting Massachusetts, the Commission has a plain answer on its Know the Laws page: out-of-state residents cannot purchase medical marijuana in Massachusetts. This page quotes that answer and the related lines in 935 CMR 501, says where they stop and points you to the right agency for your own state.
What the Commission says
"Out-of-state residents cannot purchase medical marijuana in Massachusetts. Only Registered Qualifying Patients who are residents of Massachusetts or their Caregivers are allowed to purchase medical marijuana."
The Commission also says you cannot cross state lines with marijuana: it is illegal to drive across state lines with any kind of medical marijuana product, or to transport it on a plane, train, boat or other mode of transportation outside Massachusetts. You cannot send it by mail, even to states and countries where marijuana or medical marijuana use is legal.
The one residency exception
Registration requires Massachusetts residency for most patients. The Commission says proof of residency is required for all patients unless they are receiving palliative or end of life care or cancer treatment in Massachusetts. 935 CMR 501.002 defines a Qualifying Patient to include a non-Massachusetts resident receiving end-of-life or palliative care or cancer treatment in Massachusetts, as determined by a certifying provider. The Commission page does not exempt that patient from certification or registration.
What the regulation text says about other states
935 CMR 501.140(2)(a) says a treatment center may dispense only to a Registered Qualifying Patient who has a current valid certification with the Commission or Other Jurisdictions that permit the medical use of marijuana, or their caregiver. Other Jurisdiction is defined in 935 CMR 501.002 as the United States, another state, or a foreign jurisdiction, or a military, territorial or Native American tribal authority. The Commission pages read for this page describe no process for a visitor to use another state's card, and its Know the Laws page says out-of-state residents cannot purchase. This page does not reconcile the two. Ask the Commission before you travel.
The protection stops at the border
Registered patients in Massachusetts sign an attestation in 935 CMR 501.015(5)(g) that they understand the protections for possession of marijuana for medical use apply only within Massachusetts. The same holds for any other state's law. This page cannot tell you what another state protects.
What visitors can do
- Check your own state's medical marijuana agency for what your card does when you travel. This page has no information on any other state's program.
- If you are 21 or older, the Commission says a visitor with a valid government-issued ID can buy from an adult-use Marijuana Establishment, and must use it in Massachusetts.
- If you move to Massachusetts, you can get certified by a Massachusetts certifying provider and register with the Commission. A U.S. passport, military ID or Permanent Resident Card works for ID, with proof of residency.
