Under state rules, a Massachusetts treatment center chooses whether it takes advance orders or delivers to patients. This page says what the regulation requires when a center does.
Ordering ahead
A treatment center may allow advance ordering of Marijuana and Marijuana Products by telephone, website or third-party platform(state regulation).
A treatment center may fulfill advance orders through contactless means, with no contact between the Qualified Patient or Personal Caregiver and a Registered Marijuana Agent(state regulation).
A physical unit used to fulfill an advance contactless order must ensure that access to orders is limited to the Qualifying Patient or Personal Caregiver who placed the advance order(state regulation).
A pickup unit must be located within the treatment center building and bolted or otherwise permanently affixed to the premises(state regulation).
Orders placed in advance must not be retained in a pickup unit overnight or outside of business hours(state regulation).
A center that uses contactless fulfillment must have a written operations plan, which it submits to the Commission before starting and on request(state regulation).
Who may deliver
A treatment center, or a Marijuana Courier acting for it, must obtain Commission approval before delivering directly to a registered patient or caregiver(state regulation).
Everyone who delivers for a treatment center directly to registered patients and caregivers must be an employee of the licensee holding a valid agent registration, or an employee registered as an agent of a Marijuana Courier(state regulation).
A Marijuana Courier is licensed to deliver directly to registered patients or caregivers from a treatment center(state regulation).
A Marijuana Delivery Operator is licensed to sell and deliver Finished Marijuana Products directly to Consumers(state regulation).
When and where
All deliveries must be completed between 7:00 A.M. and 11:00 P.M. local time(state regulation).
A Host Community may set alternative delivery hours by ordinance or by-law, but may not set an earlier start or a later finish(state regulation).
Treatment centers may deliver only to the primary residence, and may not deliver to college or university dormitories or housing, federally-subsidized housing, shelters or residential programs(state regulation).
An Institutional Caregiver may only receive delivery at their Caregiving Institution(state regulation).
A treatment center may only deliver an order it has received from a registered patient or caregiver(state regulation).
A treatment center may deliver only one Individual Order per patient or caregiver during each delivery(state regulation).
Only marijuana and marijuana products that are shelf-stable may be delivered(state regulation).

At your door
At a residence delivery, the courier or agent must inspect the patient's or caregiver's temporary or annual registration card and proof of government-issued identification(state regulation).
The patient or caregiver receiving the order and the agent must sign the manifest, and a signed manifest serves as the written record that the delivery was completed(state regulation).
The manifest must include the patient or caregiver's name, address, and registration number(state regulation).
A treatment center must retain all transportation manifests for no less than one year(state regulation).
Vehicles
Patient delivery vehicles must be owned or leased by the treatment center or courier and registered as commercial vehicles, inspected and insured in the Commonwealth of Massachusetts(state regulation).
